This Agreement is between San Jacinto Community College District (“SJCCD”) and the student submitting work for publication.
Purpose: SJCCD desires to reproduce, publish, or distribute student literary, visual, or electronic works in printed or electronic media, including the SJCCD web site and social media sites such as Facebook. The purpose of publication is to promote and celebrate the contributions and talents of SJCCD students and to increase public awareness of SJCCD programs.
Student’s Assurance of Originality: The Student warrants that (i) he or she created the Work identified in this agreement, (ii) the Work is original, (iii) Student has not borrowed from or infringed upon a copyrighted work created by a third party, and (iv) the Work contains no false, illegal, or defamatory content.
Consent to Publish and Waiver of Compensation: In consideration of the opportunity to have the Work published, the Student grants SJCCD the non-exclusive right to use, distribute, and transmit the Work on the SJCCD website, on social media sites, and in written materials published by SJCCD. The Student agrees that SJCCD retains the sole discretion to decide whether to publish the Work. The Student further agrees that the Student will not receive any compensation at any time for SJCCD’s use of the Work now or in the future. Depending on the context and medium in which the Work is published and any space limitations that may exist, SJCCD will credit the Student by including the Student’s name by or near the Work.
Modifications to the Work: The Student agrees that SJCCD may edit, excerpt, or modify the Work, incorporate the Work into another work such as a montage, collage, annotation, or compilation, or incorporate the Work into a multimedia hypertext environment, including appropriate hyperlinks. The Student waives the right to inspect or approve the edits or modifications that may be made by SJCCD to the Work prior to publication. The Student assigns and transfers to SJCCD all rights, interest, and title in and to all works based upon, derived from, or incorporating the original work.
Student’s Retention of Rights: The Student retains the right to distribute copies of the original Work to Student’s family members and friends or to publish it on the Student’s on social media sites. If the Student chooses to publish the original Work on the Student’s own social media sites, the Student may not include or reproduce the SJCCD logo without the prior written approval SJCCD’s vice chancellor of marketing, public relations, government affairs, and the campus provost.
Hold Harmless: The Student agrees to indemnify, defend, and hold harmless SJCCD, it’s trustees, and employees from any claims, damages, or injuries relating to the Work asserted by any person or entity, including, but not limited to, claims of copyright infringement, claims for libel and invasion of privacy, and any other claim based on the use, distribution, or publication of the Work. The Student releases and holds harmless SJCCD, its trustees, and employees from any and all claims, damages, and/or injuries experienced by the Student as a result of publication of the Work.
Withdrawal of Consent: This consent to publish the original Work shall remain in effect until consent is withdrawn in writing. The Student shall submit the written withdrawal of consent to the campus provost. Upon receipt of a withdrawal of consent, SJCCD shall have 60 days in which to remove the original Work from a web site or other electronic media site over which SJCCD has control. The withdrawal of consent shall not affect the right of SJCCD to distribute previously printed matter, such as brochures, posters, or magazines that feature the Work, or to distribute works that are derived from or incorporate the Work.
Consent: This Agreement constitutes the entire agreement between the Student and SJCCD. I am not relying on any statements or promises not contained in this Agreement. I have carefully read this Agreement and understand its contents. I voluntarily agree to the terms of this Agreement and have not been pressured in any way by SJCCD to sign this document.
